Agreement to these Terms
These Terms of Service (“Terms”) are a legally binding agreement between you and ScoreBouncer (“ScoreBouncer,” “we,” “us,” or “our”) governing your access to and use of scorebouncer.com, our progressive web application, and related services, features, content, and communications (collectively, the “Service”).
By creating an account, clicking an acceptance control, accessing, or using the Service, you agree to these Terms and acknowledge our Privacy Policy and Cookie Policy. If you use the Service for a team, league, club, school, employer, or other organization, you represent that you have authority to bind that organization, and “you” includes the organization.
If you do not agree, do not access or use the Service. Mandatory consumer rights that cannot lawfully be waived remain unaffected.
Eligibility and minors
- You must be legally capable of entering a binding agreement in your jurisdiction.
- Children under 13 may not create their own ScoreBouncer accounts.
- If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms and supervise your use.
- Where local law sets a higher age for consenting to an online service, parental or guardian authorization is required until that age is reached.
Parents, guardians, schools, clubs, and league organizers are responsible for obtaining legally required consent before submitting a minor’s information or image and for avoiding unnecessary public disclosure of a minor’s contact, location, schedule, emergency, or other safety-sensitive information.
What ScoreBouncer provides
ScoreBouncer provides tools for cricket team and league management, scheduling, roster administration, Playing XI selection, scoring, scorecards, commentary, standings, statistics, rankings, venues, officials, and public match viewing. Features may change, be added, removed, limited, or discontinued.
ScoreBouncer is a technology platform, not a cricket governing body, league commissioner, umpire, selector, disciplinary authority, safeguarding authority, medical provider, emergency service, betting operator, or guarantor of official results.
A score, result, ranking, eligibility determination, DLS figure, statistic, commentary statement, or roster on the Service is only as accurate as the information entered and the rules configured by users. The applicable league, tournament, club, match officials, or governing body—not ScoreBouncer—has final authority over official rules, eligibility, protests, corrections, sanctions, awards, and results.
Accounts and account security
- Provide accurate, current information and keep it updated.
- Use one account per individual unless we expressly authorize otherwise.
- Keep your password and device secure and do not share session access.
- Notify us promptly if you suspect unauthorized access, impersonation, or misuse.
- You are responsible for activity conducted through your account until you notify us and we have a reasonable opportunity to act.
We may require identity, role, or authority verification before allowing sensitive actions or responding to account, privacy, score-correction, or legal requests. We may refuse names, profile information, or identifiers that are deceptive, unlawful, infringing, abusive, or likely to create confusion.
Organizers, captains, scorers, and officials
Users with management or scoring privileges have elevated responsibilities. You agree to:
- Use permissions only for teams, leagues, seasons, and matches you are authorized to manage.
- Enter scores, wickets, extras, Playing XIs, roster changes, results, and disciplinary adjustments honestly and with reasonable care.
- Follow applicable competition rules, safeguarding obligations, privacy laws, and instructions from authorized officials.
- Maintain any required consent for players, minors, photographs, contact details, and roster publication.
- Resolve cricket disputes through the competition’s rules and officials rather than treating ScoreBouncer as the adjudicator.
- Correct known errors promptly and preserve historical integrity when editing completed records.
League owners, organizers, team organizers, captains, scorers, umpires, and other users are independent users. They are not employees, partners, agents, or representatives of ScoreBouncer merely because they use a title or feature on the Service.
User content and public records
“User Content” includes names, profiles, photos, logos, banners, descriptions, rosters, schedules, locations, rules, commentary, messages, scores, statistics, and other information submitted through the Service.
Ownership
As between you and ScoreBouncer, you retain any ownership rights you have in your User Content. You remain solely responsible for it and for having all necessary rights, notices, permissions, and consents.
License to operate the Service
You grant ScoreBouncer a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, format, adapt, display, publish, distribute, transmit, and otherwise use User Content as reasonably necessary to operate, secure, improve, demonstrate, and promote the Service. This license lasts for as long as the content is stored or used in accordance with these Terms, our Privacy Policy, or legal obligations. Public match and statistical records may remain after account closure to preserve historical integrity.
Public nature
Public profiles, rosters, matches, commentary, statistics, rankings, league pages, and uploaded public images can be viewed, shared, indexed, copied, or captured by others. Do not submit content you are not authorized to make public.
Moderation
We may review, restrict, remove, preserve, or disclose User Content when reasonably necessary to operate the Service, respond to reports, enforce these Terms, protect safety, comply with law, or preserve evidence. We are not obligated to monitor all content and do not endorse user statements.
Acceptable use
You may not use the Service to:
- Violate law, competition rules, sanctions, court orders, or another person’s rights.
- Impersonate anyone; falsify identity, role, eligibility, scores, results, statistics, or authority; or manipulate records fraudulently.
- Harass, threaten, exploit, discriminate against, defame, stalk, dox, or endanger another person.
- Upload unlawful, sexually exploitative, hateful, violent, deceptive, infringing, malicious, or privacy-invasive content.
- Publicly disclose a minor’s address, phone number, emergency contact, precise routine, or other safety-sensitive information.
- Upload malware, scrape or harvest data without authorization, bypass rate limits or access controls, probe security, reverse engineer except where law expressly permits, or disrupt the Service.
- Use automated means to create accounts, submit spam, copy databases, train competing systems, or extract player information without our written permission.
- Use ScoreBouncer data as a guaranteed source for wagering, gambling settlement, financial decisions, medical decisions, emergency response, or other high-risk purposes.
- Sell, rent, transfer, or commercially exploit account access or non-public data without authorization.
We may investigate suspected violations and cooperate with authorized organizations or authorities where lawful.
ScoreBouncer intellectual property and feedback
The Service, including its software, design, branding, logos, compilation, interfaces, original text, and other materials supplied by ScoreBouncer, is owned by or licensed to ScoreBouncer and is protected by intellectual property and other laws. Except for the limited right to use the Service under these Terms, no rights are granted.
You may not copy, modify, distribute, sell, license, remove notices from, or create derivative works from the Service except as expressly permitted by law or written permission.
If you provide ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.
Copyright complaints
Send a detailed copyright or trademark complaint to info@scorebouncer.com. Include your contact information, identification of the protected work, the allegedly infringing material and its location, a good-faith statement, a statement of accuracy and authority, and your physical or electronic signature. Knowingly false complaints may create legal liability.
Third-party services
The Service relies on or may link to third-party hosting, database, storage, analytics, maps, social, app-store, messaging, and other services. Third parties operate under their own terms and policies. We do not control and are not responsible for their content, availability, security, acts, omissions, or charges.
Public images may be stored through public object storage and accessible to anyone with the URL. External links do not imply endorsement. Your use of a third-party service is at your own risk and may require a separate agreement.
Availability, changes, and beta features
The Service may be unavailable, delayed, interrupted, inaccurate, or affected by maintenance, internet failure, third-party outages, software defects, user error, data corruption, cyber incidents, or events outside our control. We do not promise any particular uptime, feature, storage duration, compatibility, or error-free operation.
Features identified as beta, preview, experimental, estimated, projected, automated, AI-assisted, DLS-related, or unofficial may be incomplete or inaccurate and should be independently verified. You are responsible for keeping any backup or export necessary for your organization.
We may change limits, interfaces, permissions, data models, or features. If paid services are introduced, the price and any supplemental terms will be shown before purchase. Refund rights, if any, will be governed by the applicable purchase terms and mandatory law.
Suspension, termination, and account closure
You may stop using the Service at any time. You may request account closure by contacting us, subject to identity verification and record-retention requirements.
We may limit, suspend, or terminate access; remove permissions; quarantine content; or take other reasonable action if we believe you violated these Terms, created legal or security risk, failed to pay an applicable fee, misused roles, threatened safety, or if continued service is no longer commercially or technically feasible. Where appropriate, we may provide notice and an opportunity to appeal, but immediate action may be taken for urgent security, fraud, safety, or legal concerns.
Termination does not erase obligations or rights that by their nature should survive, including provisions on User Content licenses, public historical records, intellectual property, disclaimers, liability, indemnity, disputes, and miscellaneous terms.
Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.
ScoreBouncer disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Service or any score, statistic, ranking, result, commentary, projection, DLS figure, roster, eligibility record, or user content is complete, official, current, secure, uninterrupted, or error-free.
You assume the risks of relying on user-entered cricket data. Always confirm official decisions with the authorized league, competition, club, or match officials. Nothing in the Service is legal, medical, financial, safeguarding, emergency, or professional advice.
Limitation of liability
To the maximum extent permitted by law, ScoreBouncer and its owners, affiliates, personnel, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, goodwill, data, records, business opportunity, or use, arising from or relating to the Service, even if advised of the possibility.
To the maximum extent permitted by law, the aggregate liability of ScoreBouncer for all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid directly to ScoreBouncer for the Service during the twelve months before the event giving rise to liability; or (b) US $100.
These limitations apply regardless of legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot lawfully be excluded or limited, such as liability for fraud, intentional misconduct, or death or personal injury caused by negligence where applicable law prohibits limitation.
Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless ScoreBouncer and its owners, affiliates, personnel, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from or related to:
- Your use or misuse of the Service.
- Your User Content or information you submit about another person.
- Your scoring, organizing, roster, eligibility, safeguarding, or administrative decisions.
- Your violation of these Terms, law, competition rules, or another person’s rights.
- A dispute between you and another user, player, team, organizer, official, league, or third party.
This obligation does not apply to the extent a claim results from ScoreBouncer’s own unlawful conduct. We may control the defense and settlement of an indemnified claim, and you agree to cooperate. We will not settle a claim requiring your admission of liability or non-monetary obligation without your consent, not to be unreasonably withheld.
Dispute resolution, arbitration, and class waiver
Informal resolution first
Before filing a claim, you and ScoreBouncer agree to send a written notice describing the dispute, requested relief, and relevant account information to info@scorebouncer.com and attempt in good faith to resolve it for at least 30 days. This requirement does not prevent urgent requests for injunctive relief.
United States arbitration agreement
If you reside in the United States, any dispute arising from or relating to these Terms or the Service that is not resolved informally will be resolved by final and binding individual arbitration under the U.S. Federal Arbitration Act, administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The arbitrator may award the same individual remedies a court could award. Judgment may be entered in any court with jurisdiction.
Either party may bring an individual claim in small-claims court if eligible. Either party may seek temporary or injunctive relief in court to protect intellectual property, security, privacy, or prevent unauthorized access.
No class or representative proceedings
To the extent permitted by law, disputes must be brought only in an individual capacity and not as a plaintiff, class member, private attorney general, or representative in any class, collective, consolidated, or representative proceeding. The arbitrator may not combine claims without all parties’ written consent.
Thirty-day arbitration opt-out
You may opt out of the arbitration agreement by emailing info@scorebouncer.com within 30 days after first accepting these Terms. Use the subject “Arbitration Opt-Out” and include your name, account email, and an unambiguous statement that you opt out. Opting out does not affect other Terms.
Courts and mandatory consumer rights
If arbitration does not apply, is opted out of, or is unenforceable, disputes will be brought exclusively in the state or federal courts located in Loudoun County, Virginia, and each party consents to jurisdiction and venue, except that consumers may bring claims in another forum when mandatory local law grants that non-waivable right. You and ScoreBouncer waive jury trial to the extent permitted by law.
Governing law and international users
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws rules, and by applicable U.S. federal law. This choice does not deprive consumers of protections that cannot be waived under the law of their habitual residence.
You are responsible for determining whether the Service is lawful and appropriate where you use it. You may not use the Service if you are prohibited under applicable sanctions or export-control laws. You may not export, re-export, or provide access to the Service in violation of law.
Changes to these Terms
We may update these Terms to reflect changes in the Service, law, risk, or business practices. We will post the updated Terms with a revised effective date and provide additional notice where required. We may require renewed acceptance for material changes.
Unless law requires otherwise, material changes apply prospectively. Continued use after the stated effective date constitutes acceptance when legally valid. If you do not agree to revised Terms, stop using the Service.
Miscellaneous
- Entire agreement: These Terms and incorporated policies are the entire agreement about the Service unless supplemental written terms apply.
- Severability: If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder stays effective.
- No waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not transfer these Terms or your account without consent. We may assign them in connection with a reorganization, financing, merger, or transfer of the Service.
- No third-party beneficiaries: These Terms do not create rights for third parties except as expressly stated.
- Force majeure: We are not liable for delay or failure caused by events beyond reasonable control.
- Headings: Headings are for convenience and do not limit interpretation.
- Electronic communications: You consent to receive agreements, notices, and records electronically, subject to applicable law.
